Conditions of Submission
This document lays out the terms and conditions under which you agree to submit work to ArtReview Ltd.
Definitions
Throughout these Conditions:
– ‘Date of Publication’ means the date Your Work is first published by ArtReview Magazine or on the ArtReview Website;
– ‘ArtReview Magazine’ means ArtReview Magazine, ArtReview Asia and any other forms of print that we publish under the title of ArtReview;
– ‘ArtReview Website’ means www.artreview.com;
– ‘ArtReview Digital’ means the electronic digital version of the magazine;
– ‘ArtReview Publications’ means ArtReview Magazine, ArtReview Asia, ArtReview Website, ArtReview Digital and any other electronic database or format;
– ‘Your Work’ means any written works, photographs or images to be submitted to ArtReview by you from this day forward.
If Your Work is written, the article submitted must be satisfactory in form and content to meet ArtReview Ltd’s publication standards. ArtReview Ltd may require revision of the article and reserves the right to edit the article. You agree to cooperate with ArtReview Ltd’s revision and editing process. In the event that ArtReview Ltd determines that the article is unacceptable or that it cannot successfully be revised, ArtReview will pay you 25 percent of the agreed fee. In the event ArtReview pulls the article for any reason other than the above named, you will receive the full amount of the agreed fee.
In submitting your work to ArtReview you warrant that: to the best of your knowledge you are the author and sole copyright owner of Your Work and can prove ownership; Your Work is original and has never been published in any form – in print, online, electronically or digitally; you have secured all necessary permissions or releases from any individual(s) featured or quoted in your work; your work is not libellous, does not violate the right of privacy or other right of any third party and is not in any way illegal.
ArtReview will pay you within six weeks of the Date of Publication of Your Work on receipt of a valid invoice from you confirming your payment details. By accepting a commission from us, you agree that we may issue self-billed invoices on your behalf. If you are VAT registered, please provide your VAT certificate. In submitting Your Work to ArtReview under these conditions, you confirm that you agree the payment is adequate remuneration for the right to use Your Work.
For the agreed fee you hereby grant ArtReview a worldwide licence to use, copy, store, print, publish, display, reproduce and distribute Your Work in any ArtReview medium. The licence will be exclusive to ArtReview for the period of 12 months following the Date of Publication. In the event of syndication outside of ArtReview, you will receive an additional payment in accordance with ArtReview’s normal syndication procedure (50 percent of the syndication sale price). If, after the 12-month period, you wish to syndicate Your Work, you agree to credit ArtReview and to notify us in writing prior to publication. While such a sale will not reasonably be obstructed, ArtReview reserves the right to veto it in certain circumstances.
You will retain all copyright in Your Work. ArtReview accepts that you have the right to be clearly and prominently identified as the author of Your Work, and ArtReview will ensure that you are duly noted as the author in ArtReview Publications owned or licensed by ArtReview.
